These terms and conditions govern your use of our website and services as a client of WebSage. Please read these terms carefully before using our services. By using our services, you agree to be bound by these terms and conditions.
Change in Pricing & Packages:
WebSage reserves the right to modify its pricing and services at any time without prior notice. The information provided on our website regarding prices and services may be subject to change without notification. The decision to increase prices is solely made by WebSage, and the updated prices will apply to all new agreements. Although the new pricing will apply to all new deals, orders placed before the announcement of the updated prices will still be honored at the previous rate, with the exception of domain and hosting services.
Late / Non-Payment :
- All technical support will be revoked if your account is 7 days past due.
- Your site and other services will be suspended if your account is 14 days past due.
- Your sites and data will be erased from all of our systems if your account is 30 days over due.
At WebSage, we will make every attempt to reach you through all available means of communication. However, it is the responsibility of our clients to keep their contact information, such as their address, phone number, and billing information, up-to-date. We regularly update our database to ensure that we have the most current information available. WebSage cannot be held accountable if a client fails to receive our notifications due to outdated contact information that has not been updated in our database. The responsibility of maintaining accurate information lies solely with the client. WebSage cannot be held responsible for any actions taken as a result of a client’s failure to receive or respond to WebSage’s notifications.
Spam Policy :
At WebSage, we maintain a strict policy against unsolicited commercial email (UCE) or SPAM on our network. Our network cannot be used by our clients or associates to transmit unsolicited commercial email. Our resellers are not permitted to host or support the hosting of sites or information promoted through UCE from other networks.
Violations of this policy may result in serious consequences, including immediate termination of services. Upon receiving notification of a violation of our spam and UCE policy, WebSage will immediately initiate an investigation. During the investigation, client access to our network may be limited. If the violation is confirmed, WebSage reserves the right to cancel, terminate, or abort the respective account without prior notice. We also have the legal right to pursue a civil lawsuit to recover the costs associated with the investigation. If the infraction is found to be a criminal offense, we may inform law enforcement authorities.
Penalties will be imposed on violators of this policy, including an administrative fee. WebSage’s shared servers do not allow mass mailing and we do not engage in any business with such websites. Sending bulk emails using your SMTP server account is not recommended. For mass emailing, we advise that you hire professional services from a third party or purchase your own dedicated server.
General
It is strictly prohibited to transmit, store, or distribute any information, data, or material that violates any applicable law or regulation, or that could enable the violation of any such law or regulation. During the investigation of any suspected illegal activity, WebSage reserves the right to cooperate with legal authorities or affected parties.
Injury or Harm to Others: Our clients are not allowed to use our services or products to cause harm or attempt to cause harm in any way, including for the purpose of promoting or distributing harmful material such as pornography, or material that incites violence or destruction of property.
Infringement of Intellectual Property: Clients are not permitted to use any of our services or products to broadcast any material (via email, uploading, posting, or any other means) that infringes on any third-party copyright, patent, trademark, or trade secret, or other proprietary rights, including but not limited to the unauthorized copying of copyrighted material and the digitization and distribution of images or photos from any source, such as magazines, books, or other copyrighted materials.
Invasion of Privacy: Clients are not allowed to use our services or products to gather or attempt to gather private information about third parties without their permission or knowledge. The distribution and/or redistribution of copyrighted material, as well as the aforementioned invasion of privacy, will not be tolerated.
What do you own and What Not: Source Code/Database of Website :
- Client does not own source code unless stated otherwise by WebSage’s sales/development team.
- Clients do not own database software such as MySql and do not have access to it. However, clients own the data and content stored in the database if they built the website themselves.
- Domain name ownership – Clients do not legally own the domain name even though they are registered as the domain owner. They have a contract with the domain registrar for the exclusive right to use the domain name, but it does not grant legal ownership.
- Clients do not legally own the web server platform, CMS, web platform, database software, or the language used to develop the website. WebSage only offers a license to use the intellectual property of the website built with its own custom code.
- Ownership of website elements – If a client programs the website themselves or has a “work for hire” arrangement, they will possess the source code of the website. The client will own all of the website’s visual design and content if they create it themselves. Upon completion and final payment of the project, the client only owns the finished assembled work which includes HTML/CSS/Javascript, graphic design, and text content.
Conclusion: WebSage will not provide clients with the source code of the website, which includes the CMS technology, databases, sub-domains, or web hosting information. The back-end of both custom and template-based websites, as well as sub-domains, produced by WebSage is the result of extensive research and development, and the company retains ownership of its technology. If a client terminates their services with WebSage, they can take control of the domain name if it was purchased by WebSage, after making all necessary payments. WebSage will not disclose the source code or backups, including the website’s Admin Panel and database mysql files. Upon completion of the project and receipt of full payment, the client has the right to receive the HTML/CSS/Javascript, graphic design, and text content.
Web Hosting Access: To protect the technology of the website and maintain the security of the server from any malicious software or viruses, WebSage will not provide clients with access to web hosting credentials at any time. Clients will receive web hosting as part of their website services package. WebSage reserves the right to deny the installation of any open-source or third-party software, plugins, modules, components, or CMS such as WordPress, Joomla, Drupal, Magento, Shopify, or others unless otherwise specified in writing by the sales team.
Payment and Refund Issue :
WebSage will only accept payments through their established payment methods and does not provide any form of refund, as all projects are completed with the client’s full agreement and cooperation. Orders cannot be cancelled once placed, and any changes in personal preferences cannot be used as a reason for a refund or chargeback. The company will not provide the content on any physical medium and the client will be solely responsible for the security of their login information and the website’s content. Payments for WebSage’s services must be made under the name “WebSage” only, as the company is not responsible for transactions made with any other non verified individual or organization claiming to represent WebSage.
Matter of Disputes and Jurisdictional Aspects :
In case of any legal dispute related to WebSage, it will only be resolved in Dehradun’s jurisdiction and will be subject to the laws and regulations of Dehradun. All legal matters will be dealt with exclusively by the courts in Dehradun.
By accepting the proposal or making a payment for your work, you are acknowledging and agreeing to these terms and conditions. It is your responsibility to carefully read and understand all the terms and conditions before accepting them.
